FWMK’s Insolvency and Litigation Departments are once again involved in an important precedent ruling made by the Insolvency Court

FWMK’s Insolvency and Litigation Departments represent Adv. Assaf Shomrat, who the insolvency court appointed as the trustee of IDC InvestDotCom Ltd., a company incorporated in Cyprus.

During the proceedings, the trustee and our team sought to locate the rights and assets of IDC Ltd., which included investigating Mr. Moshe Hogeg, who controlled the company, and his wife, Mrs. Inbal Hogeg.

However, Mr. and Ms. Hogeg refused to cooperate with the investigations, claiming they had the right to remain silent in light of ongoing criminal investigation.

On February 28th, 2023, the Insolvency Court issued a significant ruling in which all of Hogeg’s claims were denied, and our motion, filed by the trustee and our office team, was accepted.

The ruling clarifies the duties imposed on those investigated by a trustee appointed in insolvency proceedings when they are under criminal investigation, in light of the new insolvency law.
