FWMK’s Commercial Litigation department is once again associated with an important Supreme Court ruling.
In the ruling given on July 4th 2023, the Supreme Court accepted our claims in an appeal against a ruling by the Economic Department of the District Court.
As part of the original ruling by the District Court, a mandatory valuation was canceled, one previously given by a decisive expert, which was agreed upon by the parties in a mediation process.
The Supreme Court overturned the judgment of the District Court, accepted all of the appeal arguments raised, and left the mandatory valuation intact.
As part of the ruling, various determinations were made by the Supreme Court related to the disclosure obligations applicable to a decisive expert. It was also made clear that in our case, there was no real fear of bias and therefore, the mandatory valuation should be left intact.
The appellant was represented in the proceedings by FWMK’s founding partner Ofer Furth, Eli Shimon, a partner in the Litigation department, and our attorney Gil Ben Khalifa, as well as by attorneys from the Goldfarb Seligman office, Zvika Bar Natan, Merav Baruch, and Ben Bloch.
