Another successful case for our Litigation department! A motion to approve a class action against our client Hazi Hinam was denied by the Tel Aviv district court. Hazi Hinam was represented by Adv. Orr Noy, the managing partner of our firm, and Adv. Astar Nahum.
The court based its verdict on the perception that the class action will not serve the public interest, and may even constitute an illegitimate attempt to press Hazi Hinam into a settlement with the applicant and its attorneys.
The court noted that such conduct on behalf of the applicant constitutes independent grounds in American law to deny a motion to approve a class action. The verdict may indicate a shift in trend in rulings regarding approvals of class actions, was already mentioned in later verdicts and is already being used by defendants in similar cases.
