The Tel Aviv District Court granted a request for the issuance of an order to commence insolvency proceedings submitted on behalf of FWMK’s client – Cogito Capital, a private investment fund, against Mr. Amir Kabiri, the former controlling shareholder of Hapoel Tel Aviv Football Club, for a definitive debt and a debt that isn’t in dispute, in a total of approximately 48 million NIS.
Mr. Kabiri’s debts to Cogito arise from a final judgment and from a personal guarantee he provided to secure the repayment of Harel Holdings Hapoel Tel Aviv Football Club Ltd. (in liquidation), to Cogito. When the company entered insolvency proceedings in January 2017, the debt owed to Cogito became due for immediate repayment. Following the rejection by the District Court of various claims raised by Mr. Kabiri against payment of the debt, and after he moved his residence to Bosnia, FWMK’s Insolvency and Litigation departments submitted the request for the issuance of an order to commence proceedings.
After a court hearing, all of Mr. Kabiri’s claims against the request were rejected, and the request was fully granted, with the court declaring Mr. Kabiri as an insolvent.
